Pemberian grasi kepada terpidana narkoba asal Australia, Schapelle Leigh Corby, dinilai sebagai bukti Indonesia takluk di mata Australia. Hal ini akan merusak reputasi hukum Indonesia di mata internasional. Indonesia dinilai sebagai negara yang tidak tegas dalam penegakkan hukum, terutama penyalahgunaan dan peredaran gelap narkoba.

Anggota Komisi III DPR dari Fraksi PDIP, Ahmad Basarah, menyatakan keputusan pemberian grasi kepada Corby oleh Presiden SBY harus disertai dengan argumentasi dan alasan yang jelas. Tanpa alasan yang dapat diterima nalar dengan ukuran nasional interest yang jelas maka, pemberian grasi tidak ada gunanya.
"Presiden harus menjelaskan kepada publik nilai dan kepentingannya. Apa yang bangsa Indonesia dapatkan dari keputusan tersebut," jelas Wakil Sekretaris Jenderal DPP PDIP ini, di Jakarta, Rabu (23/5). 

Dia menyatakan untuk apa memberikan grasi jika pemerintah Australia belum mengeluarkan kebijakan keringanan hukuman kepada WNI yang ditahan di sana. Dia menilai Pemerintah Indonesia telah gagal dan takluk dalam bernegosiasi dengan Australia.
Ditegaskan dia, jika ada informasi hal itu dilakukan karena pemerintah Australia juga melakukan hal serupa terhadap narapidana WNI yang ada di Australia, maka pemerintah harus jelaskan siapa WNI tersebut dan apa kasusnya. "Kita harus tahu apakah barter pengurangan hukuman tersebut betul-betul beralasan dan adil, atau tidak," jelasnya.
Corby mendekam di Lapas Kerobokan Bali sejak 2004. Dia terbukti membawa marijuana atau ganja seberat 4,2 kilogram. Majelis hakim pengadilan negeri Denpasar, Bali, menjatuhi vonis 20 tahun kurungan penjara. Dalam berbagai kesempatan persidangan, wanita kelahiran tahun 1977 ini selalu mengelak bahwa marijuana itu miliknya. Bahkan, Corby mengatakan, dirinya dijebak aparat.
Dalam pembelaannya itu, baik Corby maupun tim penasihat hukumnya membantah barang berupa 4,2 kilogram marijuana yang didapat dari Tim Imigrasi dan polisi di Bandara Ngurah Rai 8 Oktober 2004, adalah miliknya. Corby dan penasihat hukumnya berdalih kalau barang itu jebakan terhadap dirinya. Singkat kata, mereka beranggapan barang itu milik orang lain yang sengaja ditaruh di tasnya.
Permohonan yang disertai linangan air mata disampaikan gadis warga negara Australia itu di hadapan mejelis hakim pada pembelaan 28 April 2005 lalu. Corby minta dirinya dibebaskan dari segala dakwaan jaksa penuntut umum (JPU) Ida Bagus Wiswantanu SH. Dia melakukan pembelaan mati-matian bersama tim pengacaranya atas requistur (tuntutan) seumur hidup yang dijatuhkan jaksa Wiswantanu pada 21 April 2005 lalu.
Pada 8 Oktober 2004, Corby melakukan perjalanan wisata dari Brisbane menuju Bali melalui Sydney. Biasanya dia ingin mengunjungi saudara perempuannya, Mercedes, yang tinggal di Bali.
Beberapa lama setelah mendarat di Bandara Udara Ngurah Rai, Corby didekati aparat Bea Cukai. Ketika itu tasnya digeledah dan ditemukan didalamnya ganja seberat 4,2 kilogram. Corby kemudian menjalani penyidikan.

REPUBLIKA.CO.ID, JAKARTA –  Pemerintah mengabulkan permohonan grasi Schapelle Corby karena pertimbangan jenis narkoba yang dibawa Corby adalah ganja dan tidak termasuk jenis pelanggaran hukum yang berat.
“Banyak perkembangan di dunia yang melatarbelakangi keputusan itu. Di berbagai negara di dunia, tidak menerapkan hukuman yang keras untuk produk narkoba jenis ganja,” kata Menteri Hukum dan HAM Amir Syamsuddin usai acara Rakornas Kementerian Hukum dan HAM di Depok, Jawa Barat, Rabu (23/5).
Bahkan, lanjut Amir, beberapa negara di dunia tidak menganggap membawa atau mengkonsumsi ganja sebagai bagian dari tindak pidana. Namun, Amir menegaskan peraturan di berbagai negara itu tidak mempengaruhi kedaulatan hukum Indonesia.
“Selama undang-undang kita (soal narkoba dan ganja) belum berubah, itu masih bentuk kejahatan. Kita hanya mengurangi (hukuman Corby),” kata Amir.
Presiden Susilo Bambang Yudhoyono memberikan grasi atau pengurangan masa tahanan kepada terdakwa kasus narkoba asal Australia, Schapelle Leigh Corby. Presiden memberikan Corby grasi lima tahun dari total vonis penjara selama 20 tahun.Menteri Sekretaris Negara Sudi Silalahi mengatakan, Grasi dari Presiden ini mempertimbangkan sistem hukum Indonesia dan warga negara Indonesia (WNI) di Australia yang juga tengah menjalani masa hukuman di sana.

Corby divonis selama 20 tahun oleh Pengadilan Negeri Denpasar, karena terbukti membawa marijuana atau ganja seberat 4,2 kilogram saat berkunjung ke Bali. Dia kini ditahan di Penjara Kerobokan Bali. Redaktur: Hafidz Muftisany. Reporter: Muhammad Hafil

Presiden SBY tak tanggung-tanggung memberikan potongan hukuman (grasi) lima tahun terhadap Schepelle Corby. Dengan potongan hukuman itu, “Ratu Marijuana” Australia akan bebas , keluar penjara 2012 ini.Corby mestinya baru akan bebas tahun 2024. Karena perempuan asal Australia membawa marijuana seberat 4,2 kg dalam tas, saat mendarat di Bali, dan oleh pengadilan diganjar hukuman 20 tahun penjara.Schepelle Corby alias “Ratu Marijuana” benar-benar telah menekuk Presiden SBY. Orang asing yang membawa ganja seberat 4,2 kg, memasuki wilayah hukum negara Republik Indonesia, bagaimana bisa mendapatkan keringanan hukuman?Semestinya Presiden SBY tidak bertindak melampaui batas, dan memberikan keringanan hukuman terhadap Corby, yang terang-terangan membawa barang yang sangat membahayakan bagi keamanan nasional Indonesia, berupa marijuana yang jumlahnya sangat besar.Mestinya Presiden SBY sebagai kepala negara berdasarkan konstitusi dapat bertindak dengan tegas melindungi negaranya dari bahaya ancaman, termasuk ancaman dari fihak asing yang berusaha merusak menghancurkan Indonesia, seperti Corby. 
Indonesia sekarang sudah menjadi pusat peredaran obat psychotropis (narkotika, ganja, dan marijuana), yang peredaran sudah sangat luas, dan membahayakan dan mengancam masa depan Indonesia, terutama generasi mudanya.
Berdasarkan penelitian sudah jutaan orang Indonesia yang terperangkap sebagai pengguna dan mengkonsumsi barang“haram” itu, barang berupa narkoba, ganja dan marijuana, dan ini sudah menjadi ancaman nasional.
Karena hukuman di Indonesia sangat ringan, sampai-sampai penjara pun sekarang sudah menjadi pusat  peredaran perdagangan narkoba. Hukuman di Indonesia tak memilik efek jera sedikitpun bagi pengguna dan pengedar narkotik, ganja, dan marijuana.
Apalagi dengan pemberian keringanan hukuman terhadap si Corby “Ratu Marijuana” oleh Presiden SBY, pasti akan menjadi preseden buruk, dan semakin meningkatkan peredaran narkotik, ganja, dan marijuana di Indonesia.
Presiden SBY sudah tidak mampu lagi melindungi negaranya, rakyatnya dari bahaya dan ancaman fihak asing, yang secara terencana ingin menghancurkan Indonesia. Karena begitu banyak para pengedar narkotik, ganja, dan marijuana, yang masuk ke Indonesia, secara legal melalui pintu-pintu bandara, pelabuhan, dan tempat-tempat transit lainnya di seluruh wilayah Indonesia. 
Bandingkan dengan negara jiran Malaysia, siapapun yang kedapatan membawa barang “haram”, tak peduli siapapun hukumannya sangat berat, gantung. Jangankan membawa barang “haram”  sampai 4,2 kg, membawa 0,5 gram barang “haram” saja, sudah digantung di Malaysia. 
Pemerintah Malaysia benar-benar memproteksi, melindungi negaranya dan rakyatnya dari bahaya dan ancaman dari luar negeri, yang ingin menghancurkan rakyatnya dengan narkotia, ganja, dan marijuana. Sehingga, Malaysia yang berbatasan dengan Thailand, sekarang menjadi negara yang aman dari ancaman dan bahaya narkotika, ganja, dan marijuana.
Dibagian lain, pakar hukum tata negara, Yusril Iha Mahendra mengkritik dengan keras atas keputusan Presiden SBY yang memberikan keringanan hukum terhadap warga Australia, Corby. Kata Yusril, sepanjang sejarah baru kali ini Presiden RI memberikan grasi atau mengampuni kejahatan narkoba. “Presiden-presiden sebelumnya tak pernah melakukan hal itu, baik terhadap napi WNI maupun napi asing,” kata Yusril. 
LSM Gerakan Nasional Anti Narkotika (Granat) menilai grasi bagi terpidana, Schapelle Leigh Corby melumpuhkan asas pemerintahan.
Grasi tersebut jelas telah mengabaikan isi UU Narkotika, yang menyatakan bahwa kejahatan narkoba adalah termasuk kejahatan yang sangat serius, yang dapat menghancurkan generasi penerus bahkan sebuah bangsa.
"Kejahatan narkoba diakui sebagai kejahatan yang dapat mengancam stabilitas negara dan keselamatan bangsa," tegas Ketua Umum Granat, Henry Yosodiningrat. Henry menyatakan masyarakat dunia melalui PBB telah mengeluarkan konvensi tentang Pemberantasan Narkotika dan Psikotropika tahun 1988.
 Konvensi ini telah dirativikasi menjadi UU No 7 tahun 1997. "Dengan memberikan grasi tersebut, Presiden telah bisa dikatakan telah melanggar artikel pertama dari konvensi tersebut," tegasnya.
Keputusan Presiden Bambang Yudhoyono memberikan grasi pada Corby akan berdampak negatif.  Henry mengakui bahwa grasi adalah hak prerogatif presiden. Tapi, katanya, grasi hendaknya diberikan dengan tidak mengesampingkan moral, rasa keadilan masyarakat, serta arah pembangunan bangsa. SBY nampaknya tidak memperhatikan lagi kepentingan nasional Indonesia dalam memberikan grasi kepada Corby.

REPUBLIKA.CO.ID, JAKARTA - Grasi atau pengampunan dengan mengurangi hukuman pidana selama lima tahun yang diberikan untuk terpidana narkotika internasional, Schapelle Leigh Corby, menuai kecaman publik. Salah satunya pakar hukum tata negara, Yusril Ihza Mahendra yang menganggap grasi tersebut melanggar hukum.

"Langkah Presiden memberikan grasi itu bertentangan dengan kebijakan pengetatan atau moratorium pemberian remisi kepada napi korupsi, narkotika, terorisme dan kejahatan transnasional sebagaimana diatur PP Nomor 28/2006," kata Yusril Ihza Mahendra dalam rilisnya kepada para wartawan, Rabu (23/5).

Yusril menambahkan grasi yang diberikan SBY kepada Corby bukanlah langkah yang bijak dalam pemberantasan narkotika di Indonesia. Bahkan dalam sejarah di Indonesia, ini merupakan kali pertama seorang presiden memberikan grasi untuk Corby, bahkan selama lima tahun. Selama ini, Corby hanya mendapatkan sejumlah remisi dari pemerintah Indonesia.

Remisi diberikan kepada napi karena kelakuan baiknya selama menjalani pidana. Jadi semacam imbalan atas perubahan sikap napi. Sementara grasi adalah pengampunan yang diberikan atas dasar belas kasihan oleh seorang Kepala Negara.

Ia pun mengisahkan saat dirinya menjabat sebagai Menteri Kehakiman, Presiden Prancis, Francois Mitterand meminta agar presiden memberikan grasi kepada napi narkotika asal negara itu. Namun ia dengan tegas menolaknya dan mengatakan Presiden RI belum pernah memberikan grasi dalam kasus narkotika.

"Saya heran, mengapa Presiden RI begitu lemah menghadapi permintaan Pemerintah Australia sehingga dengan mudahnya mengampuni napi narkotika yang dapat memberikan dampak buruk bagi harkat dan martabat bangsa," tegasnya. Redaktur: Djibril Muhammad. Reporter: Bilal Ramadhan

Duta Besar Amerika Serikat Scott Marciel mengunjungi DPR. Scott akan ditemui Wakil Ketua DPR Priyo Budi Santoso.

"Pukul 13.00 WIB saya menerima Dubes Amerika Scott Marshiel. Saya didampingi anggota Kaukus Indonesia-Amerika dan kami akan sampaikan hasil kunjungan kami ke Amerika," kata Priyo, kepada wartawan di Gedung DPR, Senayan, Jakarta, Rabu (23/5/2012).

Priyo bersama anggota Kaukus Indonesia-Amerika memang baru pulang dari Amerika. Kunjungan muhibah tersebut dilakukan dalam rangka kampanye Demokrasi di Amerika.



"Itu tadi kami akan menindaklanjuti hasil kunjungan seperti pertemuan dengan anggota Kongres yang sangat kritis khususnya terhadap Papua dan kita membalikkan pemahamanan anggota kongres tersebut,"kata Priyo.

Selain itu akan dibahas banyak hal hasil pertemuan di Gedung Putih. "Ada hal-hal lain yang juga akan saya kemukakan termmasuk pertemuan ke gedung putih bertemu dengan staf khusus Obama, Dr Rachel dan Dr Maria Utero, Wakil Menlu,"katanya. (van/mpr

Djoko mengisyaratkan Lady Gaga tetap dapat tampil di negara yang demokratis ini. Kekhawatiran organisasi masyarakat tertentu dan Menteri Agama Suryadharma Ali terhadap aksi maupun penampilan pornografi dalam konsernya nanti, menurut Djoko bisa diatasi oleh Kementerian Pariwisata dan Ekonomi Kreatif.

"Terkait dari managemennya, dari menteri pariwisata sudah mengajukan dua bulan lalu. Kalau tidak salah laporan dari menteri pariwisata (Mari Elka Pangestu, Red), bahkan desainernya pun dari desainer kita," kata Djoko di halaman Istana Negara, Jakarta, Kamis (24/5/2012).

Pihak penyelenggara maupun Lady Gaga, lanjut Djoko, telah menyanggupi segala bentuk aturan yang ditetapkan pemerintah, guna mencegah pornografi penyanyi peraih empat Grammy Award dua tahun lalu ini.

Namun, meski sudah memberi lampu hijau, namun pemerintah belum memastikan dimana konser Lady Gaga akan digelar. Sebab sampai berita ini diturunkan, Polda Metro Jaya tidak memberikan izin konser di Jakarta. "Itu dari Parekraf (desainer pakaian), Managemen menyanggupi. Oleh karena itu polisi harus bisa mengamankan (konser, Red)," tandas Djoko. [mah]

Dubes Amerika Serikat (AS) Scott Marciel mengirim tim keamanan ke Polri guna membahas keamanan konser Lady  Gaga serta mendatangi DPR RI membahas persoaln tersebut. Suatu hal yang tak pernah dilakukan pemerintah AS pada konser-konser penyanyi asing asal Amerika lainnya.

"Jadi betul ada pertemuan, tapi itu dari pihak keamanan kami yang membahas aspek keamanan. Tapi terlepas dari itu, kita tidak terlibat dengan polisi mengenai masalah ini," terang Marciel di Gedung DPR, Senayan, Jakarta, Rabu (23/5).

Meski menyatakan sama sekali tidak ikut campur atau mempengaruhi siapapun di Indonesia terkait konser ini.  Namun Marciel berharap pendapat yang berbeda dengan sekelompok ormas didengar.

"Ini kami membiarkan warga indonesia memutuskan tapi kami berharap pendapat dan pandangan warga indonesia secara keseluruhan didengar, tidak hanya kelompok kecil" terangnya.

Lady Gaga merupakan penyanyi asal AS. Marciel menegaskan, walau disebut-sebut Lady Gaga penyebar paham lesbian dan gay, sepenuhnya apa yang dilakukan di AS adalah bagian kebebasan berekspresi.
"Artis atau seniman itu adalah simbol dari kebebasan berekspresi dan menurut kami ini hal yang bagus sekali dan menurut saya juga memiliki sejarah panjang tentang kebebasan dan toleransi," tuturnya.
Sementara itu kedatangan Marciel ke DPR guna menemui Wakil Ketua DPR Priyo Budi Santoso. Dalam kesempatan itu, Marciel juga menyebut soal Lady Gaga ini semua sedang didiskusikan. Dalam pandangannya, mayoritas warga Indonesia tidak mempersoalkan kedatangan Lady Gaga. "Amerika selalu percaya kebebasan ekspresi dan Indonesia juga merasa begitu juga. Dan ini sedang didiskusikan," jelasnya.
Marciel juga yakin bahwa masyarakat dan pemerintah Indonesia pada akhirnya akan bisa mengambil keputusan yang terbaik. "Pemerintah dan masyarakat Indonesia sendiri memiliki sejarah panjang mengenai toleransi dan keterbukaan," jelasnya. (Desastian/dtk/AR)

Setelah Forum Umat Islam (FUI), kini Majelis Ulama Indonesia (MUI) dan PP Muhammadiyah menyatakan penolakannya terhadap rencana konser Lady Gaga yang bakal pada 3 Juni mendatang.

Sikap final MUI itu diputuskan dalam rapat Dewan Pimpinan Harian MUI, Selasa (22/5/2012) di Kantor MUI Pusat. Keputusan ditandatangani oleh Ketua MUI Prof KH Umar Syihab dan Wakil Sekjen Dr. Noor Ahmad.
Menunjuk surat Kapolri Cq Kepala Baintelkam Polri no.B/325/V/2012 tertanggal 21 Mei 2012 perihal konser Lady Gaga, Dewan Pimpinan MUI telah melakukan kajian dan rapat Pimpinan Harian MUI serta mendengar masukan masyarakat dan umat Islam terkait rencana konser musik Lady Gaga di Indonesia. Dengan ini MUI menyatakan MENOLAK konser tersebut dengan alasan sebagai berikut:

Bertentangan dengan prinsip-prinsip kehidupan berbangsa & bernegara serta norma agama; Lady Gaga merupakan ikon pornografi dan liberalisme budaya yang bertentangan dengan UUD 1945.

Rencana konser tersebut telah menyebabkan pro-kontra yang menguras energi bangsa dan berpotensi menimbulkan konflik horizontal. Sehingga mencegah hal negatif harus didahulukan daripada mengejar kesenangan sesaat.
MUI menegaskan, Konser tersebut telah mengumbar hedonisme, mematikan semangat kesetiakawanan sosial & solidaritas bangsa serta tidak sensitif terhadap fenomena kesenjangan sosial yang terjadi di masyarakat.

Lembaga Seni Budaya dan Olahraga (LSBO) Pimpinan Pusat Muhammadiyah
melalui surat pernyataan resminya tertanggal 20 Mei 2012 M, yang ditandatangani oleh Ketua LSBO H. Jabrohim dan Sekretaris Mustofa W. Hasyim dengan mengetahui Ketua Pimpinan Pusat Muhammadiyah Din Symasudin, menyatakan penolakannya atas digelarnya pentas musik Lady Gaga (Stefani Joanne Angelina Germanotta) di Stadion Gelora Bung Karno, Senayan, Jakarta.

Adapun pertimbangannya adalah bangsa Indonesia memiliki kedaulatan budaya. Kedaulatan budaya ini sudah terbentuk dan membentuk dirinya selama Indonesia masih bernama Nusantara sampai ketika Indonesia merdeka pada tanggal 17 Agustus 1945. Dengan kedaulatan budaya ini bangsa Indonesia mengembangkan dan melindungi potensi budayanya sendiri yang berbasis etnisitas, nasionalitas, ajaran agama, moral, nilai luhur, kesantunan, dan kepatutan dalam mengatur kehidupannya.

Lembaga Seni Budaya dan Olahraga Pimpinan Pusat Muhammadiyah sebagai bagian dari bangsa Indonesia merasa wajib dan berhak untuk mempertahankan kedaulatan budaya bangsa Indonesia dari berbagai kekuatan budaya asing yang mengancam kedaulatan budaya bangsa Indonesia tersebut. Kekuatan budaya asing global, kini ditengarai tengah berusaha melakukan penjajahan budaya terhadap bangsa Indonesia.
Pentas musik Lady Gaga, menurut Muhammadiyah dapat diketagorikan sebagai bagian dari kekuatan budaya asing yang kehadirannya dapat mengancam dan menggerogoti kedaulatan budaya bangsa Indonesia. Bentuk ancaman tersebut adalah berupa penetrasi langsung kekuatan budaya asing berupa pentas musik Lady Gaga. Kalau pentas Lady Gaga dibiarkan, maka sama halnya kita semakin membiarkan berlangsungnya penjajahan budaya Indonesia oleh kekuatan budaya asing global itu.

Bangsa Indonesia, sebagian besar adalah rakyat Indonesia sekarang tengah berada pada perjuangan besar untuk menyelamatkan diri dari kondisi kemiskinan. Proses kemiskinan, kemelaratan dan kebodohan rakyat Indonesia selama ini telah dilakukan oleh kekuatan modal dan kekuatan pasar global. Itulah yang disebut penjajahan ekonomi oleh kekuatan kapitalis global.

PP Muhammadiyah sebagai bagian dari bangsa Indionesia merasa berhak dan wajib untuk berpihak kepada rakyat Indonesia untuk bersama-sama dengan komponen dan elemen bangsa Indonesia yang lain mewujudkan kemakmuran, keadilan, dan kesejahteraannya secara mandiri.

Untuk melawan semua kondisi buruk yang dipaksakan oleh kekuatan modal dan pasar global maka sangat tidak bermoral kalau pertunjukan musik Lady Gaga yang mengumbar kemewahan dan hedonisme kehidupan diselenggarakan di Indonesia. 

Dikhawatirkan, rakyat kita yang miskin, melarat, dan merasa dipecundangi oleh orang kaya dan para pemodal serta kekuatan pasar global itu, sehingga memicu kecemburuan sosial dan menimbulkan konflik horizontal antara rakyat miskin yang mayoritas dengan segelintir orang kaya yang melakukan pesta kemewahan dengan menonton pertunjukan musik Lady Gaga.

Dengan demikian Muhammadiyah bersama elemen dan komponen bangsa Indonesia yang lain menolak pentas musik Lady Gaga, merupakan perjuangan melawan penjajahan budaya dan ekonomi, demi kepentingan rakyat dan bangsa Indonesia. Dalam konteks inilah Muhammadiyah mendukung kebijakan Pemerintah, dalam hal ini Polisi Republik Indonesia yang tidak memberikan izin bagi keberlangsungan pentas musik Lady Gaga tersebut.Desastian

BAGHDAD, May 23 (Reuters) - World powers will test Iran's readiness under pressure of sanctions to scale back its nuclear programme at talks on Wednesday aimed at easing a decade-old standoff and averting the threat of a Middle East war.
The stakes could barely be higher: global oil markets are edgy over toughening sanctions on Iran's vital crude exports and the possibility of Israeli strikes against its defiant arch-foe, which has threatened reprisals if it comes under attack.
Wednesday's meeting between Iran and six world powers - the United States, Russia, China, Germany, France and Britain - will be the second since diplomacy resumed in mid-April in Istanbul after a 15-month hiatus that saw tensions soar.
Around 15,000 Iraqi police and troops will protect the venue inside the capital's heavily fortified Green Zone, which has been the target of attacks. Tehran's suggestion of a meeting in troubled Iraq, whose leadership is friendly to Iran, was seen by some diplomats as it testing Western commitment to seeking a deal. Formal talks are expected to start around noon (0900 GMT).
"Istanbul was important because for us. It was a test of the Iranians' willingness to engage. Baghdad should focus on concrete substance," a European diplomat said. "The ball is in their court. It is they who must make the first step."
One senior Western official said the six, led by EU foreign policy chief Catherine Ashton, would make Iran "a detailed proposal that will include confidence-building measures". No details were available, however, on what these would be.
The main goal of the six powers - known as the P5+1 for the five permanent U.N. Security Council members plus Germany - is expected to be an Iranian agreement to shut down the higher-grade uranium enrichment that it launched in 2010 and has since expanded in an underground plant at Fordow that, to Israeli alarm, would be largely impervious to attack from the air.
Producing such highly enriched material in such quantities has shortened the time Iran might need to build an atomic bomb.
Iran says its nuclear programme is a peaceful bid to generate electricity and has repeatedly ruled out suspending all its enrichment of uranium, an activity which can have both civilian and military purposes.
But it has indicated possible flexibility on the higher-grade enrichment of uranium to a fissile concentration of 20 percent, the part of Iran's work that most worries the West.
INSPECTION DEAL "CLOSE"
In a possible sign of a new Iranian willingness to address concerns about its atomic ambitions, the U.N. nuclear supervisor said on Tuesday he expected to sign a deal soon to unblock an investigation into suspected work on atom bombs.
But Western diplomats will be wary of past failures to carry out extra inspection deals between the International Atomic Energy Agency and Iran, and their patience is wearing thin.
They want Iran to cease work at the Fordow site and export its stockpile of higher-grade uranium - demands that analysts say Tehran would be unlikely to accept while sanctions remain.
"The key issue is the 20-percent enrichment potential. This has to be addressed in order to have a productive outcome," said one Western diplomat.
"The marching orders for Baghdad are to have concrete ideas on the table, maybe not necessarily agree on all details of these ideas, but to have a clear commitment."
Iran maintains that it needs uranium refined to a fissile concentration of 20 percent for its medical isotope reactor. Enrichment to 5 percent of fissile purity is suitable for power plant fuel, while 90 percent constitutes fuel for bombs. The technical leap from 20 to 90 percent is easier than that to reach 20-percent purity from the lower levels around 5 percent.
Iran's chief negotiator Saeed Jalili arrived on Monday in Baghdad where he met Iraqi Prime Minister Nuri al-Maliki. Western delegations were due to arrive on Wednesday.
"The meeting may not produce any miracles," Iraqi Foreign Minister Hoshiyar Zebari told Reuters, adding: "The Iranians are coming with a positive attitude. This is what we are hearing from both sides. They are coming to move, not just to talk."
With violence from its long war waning and U.S. troops gone, Iraq's government has sought to present an Arab League Summit held last month in Baghdad and the Iran nuclear talks as a sign the OPEC country is returning to the regional diplomatic stage.
Maliki's alliance is close to fellow Shi'ite Muslims running Iran, but his government has also sought to balance relations with fellow Arab states in a region where non-Arab Iran and Sunni powers like Saudi Arabia are jostling for influence.
Insurgents tied to Sunni militant network al Qaeda launched a major string of attacks on Baghdad and other Iraqi cities just before the Arab League meeting, killing 52 people. But the run-up to the Iranian talks has been relatively quiet so far.
SANCTIONS, CARROTS AND STICKS
Ashton has said she hopes the Baghdad talks will form the basis for Tehran to eventually abandon its suspected nuclear weapons programme.
But diverging agendas stand in the way of a breakthrough.
Iran has suggested it will try to leverage its reported rapprochement with the IAEA into a deal in Baghdad to relax sanctions inflicting increasing damage to its economy, including a European Union oil embargo due to take effect in July.
But Western officials ruled out such a weighty concession so soon, even though their call for a "step-by-step" negotiating process is widely seen as a tacit admission that sanctions will have to be eased at some point.
"Sanctions are only going to be lifted if we have significant and genuine progress," one diplomat said.
Ali Larijani, Iran's influential parliament speaker, warned the West on Tuesday not to play "political games" in Baghdad based on "misconceptions" that Iran is after nuclear power to menace its neighbours and dominate the Middle East.
Emanuele Ottolenghi of the Washington think-tank Foundation for the Defense of Democracies said that some concessions from the West would be crucial: "Maybe the U.S. and the EU should agree to suspend measures of minor nature," he said.
"They don't want these negotiations to fail."
Israel, widely assumed to have the Middle East's only atomic arsenal, has made clear its scepticism about the chances for diplomacy to achieve a solution to the dispute.
Asked whether last-resort air strikes on Iran were still conceivable with apparent headway being made on the diplomatic track, Israeli Civil Defense Minister Matan said: "One shouldn't get confused for even a moment. Everything is on the table."
Clara O'Donnell, at Washington's Brookings Institution, said: "The likelihood of an Israeli military strike will remain lower while the talks are ongoing. But they are likely to keep talking about it, to keep up the pressure." On May 23, 2012, the chief negotiators of the five permanent members of the Security Council plus Germany will meet their Iranian counterparts in Baghdad to discuss Iran’s nuclear programme. This follows last April’s meeting in Istanbul, when negotiations were resumed after more than a year’s inaction. This summit will test whether Iran is serious and whether concrete results can be achieved.
The strengthening of the sanctions regime over the last six years has unquestionably triggered Iran’s return to the negotiating table. Although the main measures of the new packages are not coming into force until July, their economic consequences have already made themselves felt within the country. The devaluation of the Iranian currency, the Rial, caused by years of economic mismanagement, has accelerated dramatically. The new measures against the Iranian financial system and the oil and gas industry has led to a significant drop in state revenue.
To that end the sanctions regime must be reinforced by the international community. It would be totally counterproductive to give way to political pressures to soften or end any of the sanctions that are already in place unless Iran takes steps to prove conclusively that it is not developing nuclear weapons. It is of course essential that Iran limit its nuclear enrichment program to the needs of civilian reactors.
On the sanctions front, we propose decisive action by governments in four key areas not yet covered by the existing sanctions regime.  
First, Iran must be comprehensively denied access to the international banking system. An airtight international banking blockade must be imposed against all Iranian banks, so that Iran is completely cut off from the international financial system.
Second, companies worldwide should be required to disclose all investments and business transactions in Iran. They will then realise that their international reputation will suffer if they are publically known to be conducting business with the country.
Third, Iran must be denied all access to international shipping. Such a move would greatly damage the regime given its dependence on global trade and seaborne crude oil exports. The ports of the EU, U.S. and elsewhere must be closed to cargo shippers that service Iranian ports or do business with the Tidewater Middle East Co — the company, owned by the Revolutionary Guard, that handles 90 percent of Iran’s container traffic.
Fourth, the international community should dramatically increase pressure through the insurance and banking sector. Insurance companies or financial institutions that significantly support or contribute to Iran’s ability to trade should be identified and prohibited from doing business in the U.S. and the EU, and precluded from entering into reinsurance agreements with any insurers, financial institutions and companies there.  Financial institutions and insurers must also disclose substantial investments in entities that are known to either invest or conduct business transactions in Iran.
Private business must do more to support governments in imposing a stricter sanctions regime in Iran and to keep up the pressure on the country. It is in the long-term interest of European businesses to prevent a failure of the current negotiation process and the inevitable destabilisation of the Persian Gulf.  For companies, the economic and political costs of such a crisis would be much higher than those caused by voluntary restraint in dealing with Iran.
Some critics will say that the above measures are too stringent and detrimental to the Iranian people, while others will say that no amount of economic pressure can prevent Iran from acquiring a nuclear weapon, and so the only option is a military one. To the first group, we respond by saying that Iran’s economy is controlled by the regime (specifically Iran’s Revolutionary Guard Corps), which shamefully profits at the expense of the Iranian people. History has made it clear that the regime will never change course due to half-measures, only serious steps like the measure we’ve outlined have a chance of success. Iran is finally feeling a real impact from international sanctions.  Now is the time to not only to maintain the pressure, but increase it.
Admittedly, we cannot state with certainty that sanctions and pressure will ever compel the Iranian regime to change course. But it’s simply common sense that before even considering military action against a country, one should first exhaust every possible option to economically pressure it. Doing so will show the regime that the world is serious and committed, and is willing to do whatever it takes to stop Iran’s potentially dire pursuit of a nuclear programme.

Iran Nuclear Summit: 'Expectations Will Be Very High'

ith talks between Iran and Western powers on the Persian Gulf country's nuclear program scheduled to take place in Baghdad on May 23, RFE/RL Radio Farda's Fred Andon Petrossians spoke with Middle East specialist Kenneth Katzman about the possible outcomes of this crucial summit.

RFE/RL: U.S. Secretary of State Hillary Clinton says that the Iranians will probably be asking for assurances or actions from the West in regard to nuclear negotiations and that these would be taken into consideration. In your opinion, what kinds of assurances or actions will the Iranians be looking for?

Kenneth Katzman: Well, I think, on the one hand, that Iran has asserted that it needs a certain amount of uranium...20-percent enriched uranium...for medical use. So what is being discussed is that Iran might agree to stop enriching its own uranium to 20 percent.

But the international community would have to verifiably pledge and [ensure] that Iran [is provided] with that medical uranium -- the medical isotopes -- for medical use.
Iran also wants to know -- if they agree to make some compromises -- that some sanctions might be eased, particularly the European oil embargo that is scheduled to take full effect on July 1.
Iran wants full assurances that this could be delayed or maybe even voided entirely.

RFE/RL: A high-ranking Russian official has said that Russia’s "step-by-step" plan could be attractive to both the Iranians and the West. Do you think this offers a solution to the Iranian nuclear crisis at this juncture?

Katzman: Well, that has been the Russian plan since 2010. I think Russia came up with a stepwise approach, whereby Iran might take a verifiable step and some sanctions might be eased, and then Iran might implement further steps and sanctions might be eased further.

That plan has been attracting interest for almost two years and...I believe the [U.S.] State Department said on record that it helped formulate that plan with Russia [and that] they worked with Russia on that proposal.
So, yes, I think it is a basis [for progress]... In [EU foreign policy chief Catherine] Ashton's statement after the talks in Istanbul, she mentioned the word "reciprocity," which means that if Iran takes a step then the P5+1 groupwould have to take a step to ease the sanctions -- to provide some assurances. So, yes, this is a basis for negotiations: step by step.

​​RFE/RL: Hossein Musavian, one of Iran's top negotiators for the previous government, has told CNN that this time Iranians are proceeding in good faith and that the country's efforts at nuclear enrichment have been consigned to history. Do you believe if Iran signs the additional protocol of the Nonproliferation Treaty that Iran can continue enrichment under the supervision of the International Atomic Energy Agency?

Katzman: I think the P5+1 have moved their position and they [agree] that Iran would be allowed to keep enriching uranium but only to maybe 5 percent, which is suitable for electricity only.

And that is a movement from the previous position, which said no enrichment at all in Iran itself.
Yes, I think there could be a solution. The issue is 20-percent enriched uranium. I think the P5+1 are going to demand and I think Iran is going to accept that enrichment to 20 percent be halted.

RFE/RL: You have been quoted in "USA Today" as saying that sanctions are definitely having an effect, but that the question is whether they are "having enough of an effect." In the same article, an Iranian analyst said the country's leaders are pursuing their nuclear aspirations even as evidence mounts that sanctions are hurting the Iranian people. Do you think Iranian civil society is a kind of victim in this situation? Are the sanctions hurting Iranian civil society rather than the regime?

Katzman: It is hurting everybody. But I think it’s putting some pressure on the regime. Because there is a fear from the regime that frustration from the economic situation could boil over into new demonstrations and new protests.

So there is definitely an effect, because I think if there was no effect at all, the regime would not maybe even have come to the talks in Istanbul or even agreed to more talks.
So I think it is definitely having the effect that was intended, for now.

Iran's chief nuclear negotiator Said Jalili
​​RFE/RL: Israel's military chief Benny Gantz recently said that the Iranian authorities are rational.  The Israelis seem to have changed their tone regarding Iran's leaders. What do you think is behind this? Have they changed their minds or do they want to water down their bellicose rhetoric?

Katzman: Well, other Israeli figures have said that, too.Meir Dagan also said that the Iranian regime is rational.

I think Mr. Gantz represents more of a military point of view. The military tends to be sometimes cautious about the effects of a military reaction and many other Israeli leaders understand that the U.S. is against any military action right now.
And also the Israeli leaders understand the talks are going on. There were talks in April. There’ll be more talks at the end of May, and I think the Israeli leaders are trying to communicate that certainly there will be no consideration of Israeli military action while these talks are proceeding.

RFE/RL: You have long followed Iranian policy. Among other things, you have written articles and advised Congress on the subject. What do you expect from the nuclear negotiations in Baghdad?

Katzman: I think the expectations for the Baghdad talks are going to be very high. The expectations were low for the Istanbul talks, because there had not been talks for more than one year.

But the expectations are now raised because there are technical proposals being drafted before the Baghdad talks.
In the second round, there certainly is an expectation of getting down to concrete progress; maybe getting some outlines on what is going to be agreed to.
Maybe it won't result in precise details of a contract or an agreement, but at least an outline of what both sides are going to agree to.
I think there is that expectation for the Baghdad talks. If the talks make no more progress or just very little progress, I think there is going to be disappointment and many will start questioning again whether Iran is sincere in these talks.

World Powers Meet with Iran in Baghdad

Representatives of six world powers are meeting with Iran's nuclear negotiator in Baghdad to try to negotiate an agreement for Iran to stop producing highly-enriched uranium that Western nations fear could be used to make a nuclear bomb.
Wednesday's meeting comes hours after the head of the U.N. nuclear agency said he expects Iran to sign an agreement with the International Atomic Energy Agency “quite soon” to allow inspections of nuclear facilities. The IAEA has suspected that Iran has used some facilities for a covert nuclear-weapons program.
International Atomic Energy Agency chief Yukiya Amano returned to Vienna Tuesday after meeting chief Iranian nuclear negotiator Saeed Jalili in Iran. Amano said he and Jalili made a “decision to reach an agreement” on U.N. access to Iranian sites, including the Parchin military complex.
Western powers suspect Iran has engaged in atomic weapons research at the site. Tehran says Parchin is a conventional weapons facility and insists the Iranian nuclear program is peaceful.
White House spokesman Jay Carney called the announcement a “step forward” but said Washington would “make judgments about Iran's behavior based on actions, not just promises or agreements.”
Israel sees a nuclear-armed Iran as a threat to its existence and refuses to rule out military action against the Iranian nuclear program.
Israeli Defense Minister Ehud Barak accused Iran of trying to create a false impression of progress with the IAEA before nuclear talks with six world powers Wednesday in Baghdad. He said Iran is trying to reduce international pressure to make nuclear concessions and wants to postpone any intensification of sanctions by the foreign powers.
In a separate development, Iran's state-run IRNA news agency said Tuesday the national atomic energy organization has delivered domestically-made nuclear fuel to a research reactor in Tehran for the first time. The report said two batches of the fuel were sent to the site and one was loaded into the reactor, but gave no time frame. There was no independent confirmation of the development.
Western diplomats and analysts have said the Iranian government sometimes exaggerates its nuclear progress to try to improve its bargaining position with world powers and strengthen its domestic support.
London-based nuclear energy expert Malcolm Grimston of Chatham House told VOA the only way for Iran to prove that its nuclear program is peaceful is to accept international offers of enriched uranium for legitimate uses such as the research reactor and power plants. He said Iran also would have to dismantle the technology that allows it to raise its enrichment level to weapons-grade.
Jalili met with Iraqi President Jalal Talibani in Baghdad Tuesday ahead of Iran's nuclear negotiation with the P5+1: Britain, China, France, Russia, the United States plus Germany.

Iran Nuclear Crisis: What's On The Table At The Baghdad Talks?

orld powers are meeting with Iran in Baghdad this week over the Islamic republic's controversial nuclear program. Here are five things to know ahead of time. 

Who is meeting and why?
The five permanent Security Council members -- the United States, Britain, France, Russia, and China -- plus Germany (better known as the P5+1) are sitting down with Iran in the Iraqi capital on May 23 to discuss ways out of the Iran nuclear crisis. Western powers accuse Iran of pursuing a nuclear weapons program under the cover of its nuclear-energy activities. Iran denies the charges.

What's on the agenda?
The most urgent item on the agenda is to convince Iran to give nuclear inspectors access to the Parchin military site near Tehran. Concerns over Iran's nuclear intentions have increased since the UN nuclear watchdog, the International Atomic Energy Agency (IAEA), reported in November that Iran has carried out past activities "relevant to the development of an explosive nuclear device."
Western officials suspect Iran built a container at Parchin in 2000 for the probable testing of high explosives and want to know more about experiments there. They also accuse Iran of refusing to let UN inspectors inside Parchin until Tehran can remove incriminating evidence. Iran has dismissed the allegations as "ridiculous."
Overall, the UN Security Council is demanding that Iran suspend uranium enrichment and other activities they say could contribute to acquiring bomb-grade nuclear material until it proves its program is peaceful. Tehran says it has the right to enrich uranium as part of its nuclear energy program.

What expectations are there for the Baghdad meeting?
Expectations are guarded because the Baghdad meeting is only the second since the two sides began speaking again after a break-off of talks early last year. Nonetheless, U.S. officials say they were heartened that Tehran showed a new seriousness when they returned to the table in Istanbul in April and hope that this spirit will continue in Baghdad.
The wildcard is Iran's last-minute agreement with the IAEA to a probe of its alleged nuclear-weapons projects. IAEA chief Yukiya Amano said on May 22 that a deal between Tehran and the IAEA would be signed soon and that Parchin would be part of the agreement.
The announcement heightens speculation that Tehran may call at the Baghdad meeting for the lifting of Western sanctions against the Islamic republic in exchange for letting international inspectors visit controversial sites. If so, that would set the stage for a showdown in Baghdad, where both sides would have to make major concessions to reach common ground.

Ali Vaez, an Iran analyst at the International Crisis Group, cautions against "unrealistically high expectations" for the meeting.
"It is unlikely that any of the parties' top-priority demands will be fulfilled anytime soon," he tells RFE/RL. "It is, however, imperative that the endgame be clear from the start. This should be the goal in Baghdad."

Has Iran given any indication that it will be flexible?
Iran has vowed that sanctions will not force it to give up any aspect of its nuclear program. Supreme Leader Ayatollah Ali Khamenei said in February that "in response to threats of oil embargo and war, we have our own threats to impose at the right time."
This statement raised fears that Iran could try to close the strategic Strait of Hormuz to cut the West off from Persian Gulf oil if the nuclear crisis deepened.
But Iran's readiness to talk raises questions about whether it is really prepared to take an all-or-nothing stance.
"For them, the ideal situation would be not quite having a weapon and therefore not forcing anyone to act against them but to be close enough [to having one] to be taken seriously," says Shannon Kile from the StockholmInternational Peace Research Institute in Sweden. "That's probably where they are today. Going beyond that situation, costs would probably outweigh the benefits."

How flexible is the West?
Western powers believe Tehran is more serious about talking now because of the tough financial sanctions they have levied upon the Islamic republic in recent months. They have also promised sanctions will tighten further if negotiations show no progress.
U.S. President Barack Obama said at the G8 meeting near Washington last weekend that he was "hopeful about the discussions that will be taking place in Baghdad."
"But all of us are firmly committed to continuing with the approach of sanctions and pressure in combination with diplomatic discussions," he added. "And our hope is that we can resolve this issue in a peaceful fashion."
Washington's sense of resolve on this issue was heightened on May 18 with the U.S. House of Representatives passing a nonbinding resolution stating Iran must be stopped before it achieves a "nuclear-weapons capability."
The resolution reaffirmed "opposition to any policy that would rely on containment as an option in response to the Iranian nuclear threat."
Nonetheless, there are also reports that the White House might be willing to accept some level of enrichment activity from Iran as the price for ending the nuclear crisis.
"The New York Times" reports that officials from the United States and five other major powers are going into the Baghdad meeting prepared to offer inducements to obtain a verifiable agreement that Iran will suspend efforts to enrich uranium beyond the 20-percent level it has achieved.
Any agreement would have to include highly intrusive inspections and other guarantees that Iran's nuclear intentions are peaceful.
